Half day course - 3 CPD hours

With residential developments being built across the country to provide housing for an ever-growing population, it’s important to be confident when advising a buyer of a new build. You will undoubtedly be supplied with a mountain of paperwork from the developer – particularly if the property is part of a multi-plot development.

Developers typically impose deadlines by which exchange must take place, and clients have usually paid reservation deposits and are keen to meet the deadline. But as the legal adviser, you will have many legal and practical issues to consider, including planning and community infrastructure levy (CIL) issues, adoption of roads and section 106 agreements, and important matters of title.

We will provide you with useful practical guidance and updates on the documents you may well receive, and the statutory frameworks applicable. You will also be equipped with practical and effective ways to improve your investigations and reporting, reflecting the reality of fixed fees in this area of practice.

If you are a residential conveyancing solicitor or other practitioner dealing with new builds, whatever your level of experience or years of qualification, this course is designed for you. More junior members of the team will find the course an invaluable overview of the issues common to most new builds, while the more experienced practitioner will find it a useful refresher and update.

This course will cover

•Section 38, Section 104 and Section 106 agreements, and how your client may be affected
•NHBC and similar schemes: what you need to do
•UK Finance requirements: reporting requirements
•Planning Issues: the CIL and how it may affect your client
•Covenants and restrictions, and ensuring they benefit the property
•Reporting to your client effectively
